DEFENSIVE EUROPEAN TRADEMARK OPPOSITION

It is always possible that an unexpected opposition is filed against a CTM application as 27 trademark registers are present in the European Community, namely:

-Community Trademark Register
-International Register (WIPO) with any type of EU-country designation
-25 National Trademark Registers (the Benelux countries are combined in one trademark register)

Sometimes CTM oppositions can be complex and require an in-depth knowledge of the procedures to deal with them. Based on our knowledge and experience in CTM oppositions matters throught the years since 1996, we have built a high success rate in defensive opposition procedures. The strategic moves that we make therein more than often give a satisfactory solution for the applicant.

To defend trademarks against new possibly infringing marks filing an opposition against a new CTM application may be necessary in certain cases. We don't file oppositions for the sake of filing them. If we feel that there's no chance to be succesfull in an opposition we will advise so. Additional trademark searching before filing a CTM opposition is highly recommended in every matter to determine any possible unknown risks.
