As in all other trademark jurisdictions a Community Trademark must have distinctive character. Not all words, names, symbols or devices are able to function as a trademark. Names that are merely generic names for the goods and services for which they are used, can not be registered. Names that are merely descriptive or misleading for applicant's goods or services are often refused for registration. Devicemarks or worddevicemarks are in most cases sufficiently disitinctive for registration.
Experience in the past 10 years has shown that the European Trademark Office does refuse trademarks that are purely descriptive, but in many cases has allowed trademarks for registration that are close to being descriptive or suggestive (and have been refused for trademark registration in other jurisdictions).
